Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the website at fincalfy.com (the “Site”). The Site is the FincalFY brand and is published by Nisman Digital Lab. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

We publish FincalFY under the operating name Nisman Digital Lab; formal company registration under this name may not yet be complete.

The Site is intended for users in multiple regions, including India, the United States, the United Kingdom, the European Economic Area (including Germany and France), and Brazil. If mandatory consumer protection laws in your country conflict with any part of these Terms, those mandatory laws apply to you to the extent required.

2. What FincalFY provides

FincalFY provides general, educational tools and content related to personal finance calculations (the “Services”). The Services may include calculators, articles, comparisons, and similar informational materials.

FincalFY is not a bank, lender, broker-dealer, investment adviser, tax adviser, accountant, lawyer, insurance agent, or other regulated professional. We do not provide personalised financial, legal, or tax advice, and we do not recommend specific financial products for your situation.

3. No professional relationship

Use of the Site does not create any fiduciary, advisory, agency, partnership, or employment relationship between you and FincalFY. Communications through the Site are not confidential professional advice.

4. Eligibility

You must be legally able to agree to these Terms in your jurisdiction. If you use the Site on behalf of an organisation, you represent you have authority to bind that organisation.

5. Acceptable use

You agree not to:

• Use the Site unlawfully, fraudulently, or in a way that harms others
• Attempt to gain unauthorised access to our systems, other users, or service providers
• Interfere with the Site’s operation (for example by overloading, scraping in violation of these Terms, or distributing malware)
• Copy, reproduce, or redistribute Site content at scale for commercial purposes without permission, except as allowed by applicable law
• Reverse engineer or attempt to extract source code except where permitted by law
• Use automated means to access the Site in a way that materially impairs our infrastructure

6. Accounts

If we introduce accounts or features requiring registration in the future, additional terms may apply. Unless we explicitly offer an account feature, you do not need an account to use the calculators.

7. Third-party services, links, and advertising

The Site may contain links to third-party websites, tools, or services, and may display advertisements (including through Google AdSense). Third parties are responsible for their own content and practices. Ads and links are not endorsements unless we clearly state otherwise.

Your use of third-party services is at your own risk and may be subject to third-party terms and privacy policies.

8. Intellectual property

The Site and its content (including text, graphics, logos, layout, and software) are owned by Nisman Digital Lab (publisher of FincalFY) or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes unless we agree otherwise in writing.

9. Disclaimers

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINCALFY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Calculator outputs depend on your inputs, assumptions, rounding, and methodology. Rates, taxes, fees, and rules change over time and vary by institution and jurisdiction. Results are estimates for educational purposes and may be incomplete or inaccurate.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINCALFY AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (TYPICALLY ZERO FOR FREE USE) OR (B) ONE HUNDRED US DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless FincalFY and its affiliates from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Site, violation of these Terms, or violation of third-party rights.

12. Suspension and termination

We may suspend or terminate access to the Site if we reasonably believe you violated these Terms, pose a security risk, or if required by law. Provisions that by their nature should survive will survive termination.

13. Changes

We may modify the Site or these Terms at any time. We will update the “Last updated” date when we revise these Terms. Continued use after changes become effective constitutes acceptance of the revised Terms, to the extent permitted by law. If you do not agree, stop using the Site.

14. Governing law and disputes

Unless mandatory local law requires otherwise, these Terms are governed by the laws of India, without regard to conflict-of-law principles, and the courts located in India shall have exclusive jurisdiction, subject to any non-waivable rights you may have as a consumer in your home country.
